의료 패러다임이 환자 중심으로 전환되면서 환자 안전에 대한 새로운 접근이 강조되고 있습니다. 영상의학 분야에서는 ‘방사선량 관리’가 화두인데요. 환자가 받는 의료 방사선량이 꾸준히 증가하고 있기 때문이죠. 또한, 인터벤션(Interventional radiology)·핵의학(Nuclear medicine)·방사선 치료(Radiation therapy)와 같이 일반적인 진단검사에 비해 상대적으로 피폭량이 많은 검사와 치료의 빈도 역시 높아지고 있습니다.

 

유럽과 일본을 중심으로 진행 중인
환자 방사선량 관리 법제화

방사선 방호 국제기구인 국제방사선방호위원회(ICRP·International Commission on Radiological Protection)는 의료 방사선 사용 시 정당화(Justification)*와 최적화(Optimization)**를 고려할 것을 명시하고 있습니다. 전 세계 각국은 국제방사선방호위원회의 권고사항을 토대로 법령과 기준을 수립하는데요. 특히 유럽과 일본은 방사선량 관리를 법제화하고 관리 범위를 점점 넓혀 나가고 있죠. 

지금부터는 유럽과 일본이 방사선량 관리를 법제화하게 된 여러 배경과 세부 시행사항을 알아보겠습니다.

① 유럽 

유럽은 1986년에 발생한 체르노빌 원전 사고로 인해 방사선 방호에 대한 제도화가 비교적 빠르게 시작되었는데요. 유럽연합은 2014년 방사선 방호에 대한 안전 표준지침(European Directive 2013/59/EURATOM)을 제정하고, 발효를 거쳐 2018년 2월을 기준으로 회원국에 해당 지침을 의무화했습니다. 이에 따라 유럽연합의 각 국가들은 해당 법안을 토대로 환자 방사선 방호를 위한 법적 제도와 지침 등을 시행하고 있습니다. 

세부사항 살펴보기*

· 유럽의 모든 의료기관은 의료 방사선 사용 시 정당화(방사선 사용 시 이로움이 해로움보다 커야 함)와 최적화(피폭방사선량은 합리적으로 달성할 수 있는 범위에서 낮게 유지되어야 함)를 고려해야 합니다.

· 방사선 진단 검사 시 유럽 진단참고수준(DRLs·Diagnostic Reference Levels)을 정기적으로 검토하고 사용해야 합니다.

· 가능한 환자 또는 환자 대리인에게 의료 피폭과 관련된 이로움과 해로움에 대한 적절한 정보를 제공해야 합니다.

· 과도한 피폭 또는 사고로부터 환자를 보호하기 위해, 모든 의료기관은 피폭과 관련된 데이터의 수집, 보관, 분석을 위한 적절한 시스템을 구축해야 합니다.

· 방사선 장비 도입 시 의학물리사(Medical Physics Expert)를 선임해야 하며, 의학물리사는 의료진이 의료 방사선을 적정하게 사용할 수 있도록 전문적인 조언을 제공합니다.

② 일본

일본은 2006년 전 세계에서 처음으로 초고령화 사회로 진입했습니다. 이에 따라 예방의학에 대한 관심이 높아지면서 건강검진 촬영 역시 빠른 속도로 증가하고 있습니다. 또한 2011년 발생한 후쿠시마 원전 사고로 방사선 피폭에 대한 사회적 관심이 매우 높은 편이기도 하죠. 이러한 요인들로 인해 일본에서는 방사선량 관리에 대한 논의가 활발하게 진행되고 있습니다.

세부사항 살펴보기*

· 2018년 4월부터 영상진단관리가산 구분3 보험수가제도가 신설되어, 조건**에 해당하는 병원은 모든 CT 검사의 방사선량 정보를 기록하고 방사선량을 최적화할 경우 건당 추가 보험 수가 300점(3,000엔)을 받을 수 있습니다.

· 2020년 4월부터 일본의 모든 의료기관은 환자 피폭방사선량을 의무적으로 관리하고 최적화해야 합니다.

유럽과 일본 모두 방사선량 관리 법제화를 통해 환자 방사선량을 능동적으로 최적화하고 있습니다. 국내는 아직까지 환자 방사선량 관리에 대한 법적 규정이 없는 상황인데요. 환자 피폭방사선량이 지속적으로 증가함에 따라 정부와 의료계를 중심으로 보다 체계적인 방사선량 관리에 대한 필요성이 제기되고 있습니다.

 

③ 국내

국내 역시 환자의 의료 피폭방사선량이 증가하고 있습니다. 지난 3월, 질병관리청이 발표한 정책연구 용역사업의 연구결과인 <2016년~2019년 진단용 국민의료방사선 건수 및 피폭방사선량 현황 발표*>에 따르면, 2019년 국내 총 의료방사선 촬영 사용량은 약 3.74억 건으로, 2016년 3.12억 건에 비해 약 20% 증가한 수치이며, 연평균 약 6.2%씩 증가하고 있는 것으로 나타났습니다. 의료방사선에 의한 전 국민의 집단유효방사선량 역시 2019년 기준 약 125,000 man·Sv로, 2016년 101,000 man·Sv 대비 약 25% 증가했습니다.

세부사항 살펴보기

· 질병관리청은 의료영상진단 정당성 가이드라인을 마련하고 의료방사선 검사에 대한 평가 프로그램을 개발하는 등 국민 의료방사선 피폭방사선량을 낮추기 위한 활동들을 전개하고 있습니다.

· 지난해 제21대 국회 입법조사처는 국정감사를 앞두고 ‘의료기관이 환자의 방사선 피폭량 등을 기록·관리하도록 하는 법령상 근거를 마련할 필요가 있다’고 밝혔는데요. ‘의료법 제37조’ 및 ‘진단용 방사선 발생장치의 안전관리에 관한 규칙’에 관한 개정 검토와, 의약품안심서비스(DUR)에 착안한 방사선 피폭량 실시간 공유 프로그램 개발 검토를 제안**하기도 했습니다.

But when there is a need for retention due to internal policies and/or subordinate legislation, we will keep your information for the period specified in the legislation.

  • We will keep minimum information and usage history for the period set by law such as the commercial law, for cases where retention of personal information is.
  • We will keep your personal information for cases where we announced the retention period in advance and/or where we obtained your consent to retention.
  • For the following cases, we may keep your information for the specified period:

① Records on sales/product inquiries or searches, withdrawal from contracts/subcontracts, customer complaints or dispute handling: 5 years (Consumer Protection in E-commerce)

② Records on website visits: 3 months (Protection of Communications Secrets Act)

Disposal

By rule, INFINITT will dispose of your personal information once the purpose of collection and usage as well as the legal and business needs have been fulfilled.   • Subcontracting: we may subcontract the handling of your personal information for smoother business operations and provision of better services. The Rights of Users & Legal Representatives

 

Users and their legal representatives may request through email or in writing to access or modify personal information and to withdraw consent to the collection and use of personal information.

 

If you request to correct an error in your collected personal information, we will not use or disclose your information until the correction has been made. If we have already disclosed inaccurate personal information to third parties, we will notify them as soon as the correction has been made. In response to a request for disposal of information, we will handle your personal information as stipulated in the “Period of retention & use” and make sure that it is not accessed or used for any other purposes.

 

By rule, we do not collect personal information of children under the age of 14 for whom we need consent from their legal representatives. Management of Personal Information

 

Period of retention & use

By rule, INFINITT will dispose of your personal information when you request for the disposal or once the purpose of collection and usage has been fulfilled. But when there is a need for retention due to internal policies and/or subordinate legislation, we will keep your information for the period specified in the legislation.

  • We will keep minimum information and usage history for the period set by law such as the commercial law, for cases where retention of personal information is.
  • We will keep your personal information for cases where we announced the retention period in advance and/or where we obtained your consent to retention.
  • For the following cases, we may keep your information for the specified period:

① Records on sales/product inquiries or searches, withdrawal from contracts/subcontracts, customer complaints or dispute handling: 5 years (Consumer Protection in E-commerce)

② Records on website visits: 3 months (Protection of Communications Secrets Act)

③ Records on customer complaints or dispute handlings: 3 years (Consumer Protection in E-commerce)

④ To prevent user activities based on impure motives and to secure evidential materials in case of disputes: 3 months temporary retention (from the day of consent withdrawal)

⑤ Evidential records for a violation of internal policies (i.e. Illegal usage history): 1 year

 

Disposal

By rule, INFINITT will dispose of your personal information once the purpose of collection and usage as well as the legal and business needs have been fulfilled. Paper documents containing personal information will be completely shredded. Electronic documents containing personal information will be destroyed to a point where it is impossible to technically restore the file.

INFINITT received the certification for ISO/IEC 27001 in 2016 and has been qualified ever since.

HIPAA is an act enacted to strengthen privacy, security, and reliability of health information in the United States. INFINITT adheres to all of HIPAA requirements from the early stages of product design.

  • ISO 27701:2019

ISO 27701:2019 is an international management system standard for managing personal information.

In efforts to comply with GDPR and to effectively manage and protect personal information, INFINITT received the certification for ISO 27701:2019 in 2018 and has been qualified ever since.
